The Florida Department of Environmental Protection is appealing a federal judge’s order to restore the state’s ability to block a low-risk cruise ship’s entry into port. The U.S. District Court for the Northern District of Florida granted the state’s motion for a stay last week, stopping the U.S. Department of Homeland Security from allowing the Carnival Cruise Line’s Harmony of the Seas into Port Canaveral on July 3. The federal agency will review the case and make its decision by July 6.
The U.S. Supreme Court today took up the case of the U.S. Centers for Disease Control and Prevention, which had been ordered by the Florida state government to abandon a cruise ship program that had been testing new vaccines on patients. The Court’s decision could have a major impact on the way the U.S. and other countries employ vaccines in the future.

The State of Florida has won its continuing battle with the US Centers for Disease Control and Prevention (CDC) Conditional Sailing Order for the second time. The state appealed to the United States Supreme Court an earlier ruling that supported the CDC in keeping the cruise ship ban in place in Florida.

In a significant new development on Friday evening, Florida has won its continuing battle against the CDC’s Conditional Sailing Order over cruise ships. The Eleventh Circuit Court overturned its judgment against Florida when the state appealed to the United States Supreme Court.
Previously, the CDC was successful in getting US Judge Steven Merryday’s decision to order the Conditional Sailing Order merely as a suggestion rather than a mandate starting July 18 to be placed on hold. The stay has now been lifted, and cruise ships may continue operations without complying with the CDC order, according to the Supreme Court’s recent ruling.

Governor Ron DeSantis of Florida stated:
“I’m relieved to see the 11th Circuit Court of Appeals overturn its previous judgment and release the cruise lines from CDC requirements that essentially put the business on hold for over a year.”
“The significance of this case is not limited to the cruise sector. If and when a federal agency tries to wield such broad power that is not expressly defined by law in the future, it will be on thin legal and constitutional ice.”
Originally, Florida had filed a lawsuit against the CDC, and a federal judge ordered the two sides to meet for mediation. After the talks failed to provide a favorable result, the matter was returned to the judge, who ruled with Florida on June 18.
The CDC subsequently filed an appeal with the 11th Circuit Court of Appeals shortly before the injunction was set to take effect on July 18. The CDC was successful in maintaining its cruise ship order. The CDC’s appeal did not survive long, thanks to today’s ruling.

Without a CDC order, cruise ships may resume operations.
With the Supreme Court’s ruling, cruise ships may continue operations in Florida without having to obey the CDC’s mandate. The decision enables all cruise ships to begin operations immediately, although this is unlikely.
Cruise companies have already begun to prepare for a gradual resumption to operation. With procedures in place and following CDC standards, several boats have already begun excursions out of Florida. The truth is that the CDC’s recommendations will very certainly be followed, since reversing all of the specific procedures will likely create even more confusion for visitors.
When Will Cruises Restart in 2024?
Cruise companies have been laboring for months to iron out the tiniest of details, and this trend is expected to continue. However, we expect some minor changes to make it simpler for passengers planning for cruises departing from Florida. All we can do now is wait and watch what the cruise companies decide.
The cruise industry halted operations in March 2024, and ships have been restarting operations for the first time in recent weeks. When the Celebrity Edge left Fort Lauderdale on June 26, she became the first cruise liner to resume sailings in the United States. Cruises have already resumed out of PortMiami, the world’s cruise hub, and the first ship will depart from Port Canaveral in the coming days.
In a 2-1 decision, the U.S. Supreme Court reversed a decision by the Florida Supreme Court and reversed a local appeals court ruling that had allowed the government to block some of the Tampa-based cruise operator’s proposed itineraries. The cruises would have visited the Florida Keys and turned off one of the islands for a day, according to the Associated Press. The cruises would have departed from Port Canaveral in Florida..
